Introduction
The following Terms and Conditions of Sale apply to all orders placed via Sparkle. By using Sparkle services you agree to be bound by these Terms and Conditions.
About Sparkle
Sparkle and Sparkle.co.uk are trading names of Sound Solutions Advertising Ltd, a company registered in England, with registered number 3151141.
When you place an order via Sparkle you are placing an order with one or more individual retailers that have chosen to list their products for sale with Sparkle.
Sparkle is not the seller or reseller of the items and does not take ownership of the items at any point.
The contract formed at the completion of a sale is solely between you the customer and the individual retailer.
Sparkle is not a party to this contract and does not assume any responsibility arising out of it (e.g. distance selling regulations, statutory rights, etc).
The individual retailer is responsible for the sale of the products and for any other matters arising out of it.
In order to provide a better buying experience, Sparkle monitors the behaviour and performance of the retailers on our platform but this does not represent a guarantee or acceptance of any liability in case of disagreements or other problems between customers and retailers.
About these Terms and Conditions
These terms and conditions govern your relationship with Sparkle only. Individual retailers may have their own policies and/or terms and conditions in addition to those below.
Your legal statutory rights are not affected. These cannot be taken away by any terms and conditions.
These Sparkle Terms and Conditions take priority over individual retailers terms and conditions. They can only give you more rights than those detailed below, not less.
You can find out if a given retailer has such additional policies/terms on the retailer's profile page.
Our Responsibilities
Sparkle is responsible for:
Where you provide personal information we will hold and process this securely according to the relevant UK data protection regulations.
Where you provide monetary payment for goods and services to be provided by third party retailers on our platform we will pass along these funds subject to our agreements with those retailers (e.g. minus any fees, etc)
We will offset the carbon emissions of all sales made via the Sparkle platform.
Sparkle is not responsible for:
Sparkle will do our best to ensure that our service is provided uninterrupted and is available at all times. However due to the nature of the internet this cannot be guaranteed and we cannot be held responsible for any losses incurred as a result of down time on our services.
Sparkle will do our best to ensure that the information on our platform is accurate. However due to the number of products involved we cannot check everything and cannot be held responsible for mistakes and/or misleading product information.
Sparkle does not handle your Card Payment information. All card payments are taken via third party platforms. Sparkle cannot be held responsible for any loss of data by those services.
Retailer's Responsibilities
Retailers are responsible for:
All sales via Sparkle are subject to the Consumer Protection (Distance Selling) Regulations 2000.
You have a right to cancel any order placed with us, except for items which are perishable or personalised or customised to order.
Where you provide personal information retailers will hold and process this securely according to the relevant UK data protection regulations.
Your Responsibilities
Please read all product information, terms and conditions and delivery information carefully before placing an orders. Neither Sparkle or the individual retailer can be held responsible for your mistakes.
All information provided at the point of order must be accurate and true. You must not use a false e-mail address, fake name or postal address.
If you are under the 18 years of age you may not place an order. A parent or guardian must assume legal responsibility for the contract of sale.
It is your responsibility to ensure that, prior to returning an item to us, you have taken all reasonable care of it, including in transit when returning the item(s).
